General Terms and Conditions
Rules for using problem.hu, a free brokerage portal.
Effective from 19 October 2026.
1. Operator details
The operator is Jevgenyij Dutov, a private individual (not a legal person), operating the website problem.hu.
Registered address: 1134 Budapest, Csango utca 26., Hungary.
E-mail: mail@dutov.eu; phone: +36 1 790 6706.
Hosting is self-operated; hosting-related enquiries are also received at the above contacts.
2. Subject of the service
problem.hu is a free advertising and brokerage portal: customers post problems and repair requests, service providers (experts) bid on them, and the parties then agree directly with each other.
- The operator only provides the platform and brings the parties together; it is not a party to any later contract between a customer and a provider.
- The operator performs no repair work itself, gives no bids, and gives no warranty for work performed.
- Every function of the portal is free of charge (see point 4).
3. Conclusion of the contract
- The contract is concluded by accepting these Terms: by ticking the Terms checkbox on the forms and pressing the submit button you declare that you have read and accept the Terms.
- Customer: the contract is concluded when the problem posting is submitted.
- Provider: submitting the registration is an application; the contract entitling you to bid is concluded upon approval by the operator. Registration alone does not entitle you to bid, and the operator may refuse an application.
- The language of the contract is Hungarian; the English text is informative only, and the Hungarian version prevails in case of divergence. The contract does not qualify as a written contract, is not accessible afterwards, and is not subject to any code of conduct.
4. Free of charge
All services of the portal — problem posting, registration, bidding and messaging — are free of charge: neither the customer nor the provider pays any fee or commission to the operator.
If the operator introduces paid add-on services in the future, it may only do so by amending these Terms in advance, with the fee clearly indicated (see point 11); already concluded free relationships are not affected retroactively.
5. User obligations, prohibited content
- You provide true and accurate data; the portal may be used by persons over 18 with legal capacity (persons acting for a company must be authorised to represent it).
- You keep your login credentials confidential; you are responsible for actions performed with your account.
- You only upload text and photos you are entitled to use; you publish third-party personal data or images only with their consent.
- Prohibited in particular: unlawful, misleading, insulting or intimidating, obscene, hateful, spam-like content, content infringing copyright or containing malicious code, and obstructing the normal operation of the portal.
- Provider introductions and reference photos must not be misleading; they must relate to the professed trades and districts.
6. Moderation, removal, ban
Posted content may be checked by automated pre-screening (AI), but the fate of the content is always decided by a human moderator (see point 5 of the privacy notice for details).
- The operator may edit, hide or delete infringing content without prior notice, and suspend or delete the account in case of repeated or serious infringement.
- Photos: JPEG or PNG, max 5 MB each; 1 photo per problem, up to 5 reference photos per provider.
- Objections to moderation decisions can be raised through the complaint handling in point 8.
7. Limitation of liability, warranty
- The operator provides the platform on an “as is” basis: continuous, error-free availability is not guaranteed (the service may pause during maintenance, force majeure or third-party outages).
- The operator is not liable for performance of the contract between customer and provider: neither for quality, deadline or price of the work, nor for damage the parties cause each other.
- The publisher is responsible for the content of postings, introductions and bids; the operator removes unlawful content brought to its knowledge.
- Against consumers, liability may only be limited as permitted by law; liability for wilful or grossly negligent damage and for injury to life or health cannot be excluded.
8. Complaint handling
You may submit complaints by e-mail to mail@dutov.eu or by phone at +36 1 790 6706.
- Please indicate which account (username, e-mail address or phone number) and which problem or bid your complaint relates to.
- Complaints are answered on the merits within 30 days; rejections are reasoned.
9. Conciliation board, courts
If your complaint is rejected or not answered within 30 days, as a consumer you may turn to the county (Budapest) conciliation board competent for your domicile (contacts: bekeltetes.hu). The operator is subject to a duty to cooperate in conciliation proceedings.
The European Union online dispute resolution platform was discontinued on 20 July 2025, so no new procedure can be started there.
You may also go to court; a consumer may also sue before the court of their domicile.
10. Data protection
The detailed rules of personal data processing are set out in the privacy notice, which forms an inseparable annex to these Terms. By accepting the Terms you declare that you have read the notice.
Privacy complaints may also be lodged with the Hungarian National Authority for Data Protection and Freedom of Information (NAIH): 1055 Budapest, Falk Miksa utca 9-11.; postal address: 1374 Budapest, Pf. 603.; phone: +36 (1) 391-1400; e-mail: ugyfelszolgalat@naih.hu.
11. Amendments to the Terms
The operator may amend the Terms unilaterally; the amended, dated version is published on the gtc.php page. Continued use of the portal after entry into force qualifies as acceptance of the amended Terms; material changes are highlighted on the site.
Already posted problems and pending bids are governed by the Terms in force at the time of posting, unless the amendment is based on a change of law.
12. Governing law, effect
- These Terms are governed by Hungarian law, in particular Act CVIII of 2001 (on electronic commerce), the Civil Code (Act V of 2013), Act CLV of 1997 on consumer protection, and Government Decree 45/2014 (II. 26.) where applicable.
- Entry into force: 19 October 2026. The Terms apply for an indefinite period.
- In case of divergence, the Hungarian version prevails.
